1. Agreement and Parties
These Terms and Conditions ("Agreement" or "Terms") govern the purchase, enrollment, billing, cancellation, use, and administration of MobileMechanicNow membership plans offered through MobileMechanicNow.com ("MobileMechanicNow," "MMN," "we," "us," or "our"). MobileMechanicNow is operated by Secure Private Sale Solutions LLC ("SPS"), a California limited liability company and authorized reseller of certain Wrench, Inc. maintenance offerings.
The maintenance services and related benefits described in this Agreement are administered, scheduled, and fulfilled by Wrench, Inc. ("Wrench") and/or its authorized affiliates, technicians, service providers, suppliers, or partners. MMN and SPS do not perform vehicle maintenance services and do not employ or supervise Wrench technicians.
By purchasing, enrolling in, renewing, using, or attempting to use any Membership, you ("Customer," "Member," "you," or "your") agree to be bound by this Agreement, any plan-specific disclosures shown at checkout, and any applicable Wrench terms, policies, service rules, and warranty procedures.
2. Membership Plans Covered by These Terms
This Agreement applies to each of the following membership options when purchased through MobileMechanicNow:
- FlexCare or other recurring subscription membership plans ("Subscription Plans").
- Prepaid two-year membership plans ("2-Year Prepaid Plans").
- Prepaid three-year membership plans ("3-Year Prepaid Plans").
- Any similar, renamed, replacement, promotional, or successor membership offering sold by MMN unless separate terms expressly apply.
Plan names, prices, billing frequency, plan lengths, plan benefits, service limits, and eligibility rules may vary and will be disclosed at checkout, in the order confirmation, or in plan-specific materials. If there is a conflict between this Agreement and a plan-specific written disclosure provided at checkout, the plan-specific disclosure controls for that specific plan feature, provided it is lawful and enforceable.
3. Membership Overview
MobileMechanicNow memberships are designed to help Members access routine vehicle maintenance and related discounts through Wrench. Memberships are not vehicle service contracts, insurance policies, warranties, or guarantees against mechanical breakdown. They are maintenance and discount membership programs subject to the limitations, exclusions, service area restrictions, eligibility requirements, and waiting periods in this Agreement.
Membership benefits are available only while the Membership is active, paid, eligible, and in good standing. Subscription Plan benefits may be suspended or terminated if payments are not current. Prepaid Plan benefits remain subject to the stated term, vehicle eligibility, Wrench service availability, and these Terms.
4. Summary of Core Benefits
Subject to plan type, service availability, vehicle eligibility, benefit limits, and all other terms, membership benefits may include the following:

This benefit includes replacement of standard brake pads on both the front and rear axles of the covered vehicle, along with installation labor. Members who purchase either a twenty-four (24) month or thirty-six (36) month prepaid plan are eligible for this benefit once during their respective membership period. FlexCare members are eligible for one (1) brake pad replacement service for each thirty-six (36) consecutive months of active membership. Rotors, calipers, brake fluid, brake sensors, machining, diagnostics, additional brake system repairs, and any other parts, materials, or services are excluded unless separately purchased.. |

The benefits above are a summary only. Benefits may vary by plan, may be modified, may be subject to additional limits, and are not guaranteed in every location. Partner discounts are subject to third-party participation, availability, and terms. No benefit has cash value unless expressly stated.
5. Benefit Periods and Usage Limits
Unless a plan-specific written disclosure states otherwise, annual benefit limits are measured from the Membership effective date or applicable renewal date. Unused benefits do not roll over, accumulate, or convert to cash or credit. Benefit limits apply per registered eligible vehicle, not per driver or household.
For Subscription Plans, benefits remain available only while the subscription is active, paid, and in good standing. For Prepaid Plans, benefits remain available during the applicable prepaid term, subject to eligibility, usage limits, service area availability, and these Terms.
6. Vehicle Eligibility
Memberships are valid only for vehicles that meet Wrench eligibility requirements and any MMN plan-specific requirements. Wrench has the right to determine whether a vehicle is eligible for service or for any particular benefit.
Vehicles that may be excluded include, without limitation:
- Exotic, specialty, collector, classic, antique, modified, or rare vehicles.
- Diesel-powered vehicles where Wrench determines service is unavailable or impractical.
- Commercial, fleet, rideshare, delivery, taxi, rental, medium-duty, or heavy-duty vehicles.
- Vehicles requiring specialty tools, specialty fluids, unusual service procedures, or unsafe service conditions.
- Vehicles located outside Wrench service areas or in locations Wrench determines are unsafe, inaccessible, or impractical.
The Member is responsible for providing accurate vehicle information, including VIN, year, make, model, trim, mileage, location, and ownership or authorized-use status. MMN and Wrench are not responsible for unavailable benefits resulting from inaccurate information or vehicle ineligibility.
7. Waiting Period
A sixty (60) day waiting period applies from the Membership purchase date before covered maintenance benefits may be scheduled or redeemed, unless a written plan-specific disclosure states otherwise. Discount benefits may also be subject to Wrench processing, activation, system availability, and service provider requirements.
The waiting period is intended to support proper program administration and to help ensure the Membership is used for routine maintenance rather than immediate, known, or pre-existing service needs. Services scheduled, redeemed, or attempted before the waiting period ends may be declined.
8. Scheduling, Service Requirements, and Service Limitations
All covered services must be scheduled through Wrench or its authorized scheduling channels and performed by Wrench or its authorized service providers. Members may not schedule covered services directly with technicians outside Wrench-approved channels.
- All parts, products, supplies, and services associated with discounted benefits must be purchased through Wrench, its affiliates, or its approved suppliers unless Wrench expressly approves otherwise.
- Services are subject to technician availability, location, safety conditions, parts availability, vehicle condition, Wrench operational rules, pandemics, public health emergencies, weather, wildfires, natural disasters, strikes, civil unrest, and governmental orders which may delay or disrupt service performance beyond MMN’s reasonable control.
- Wrench may refuse service at locations it determines unsafe, impractical, restricted, or unsuitable, including roadsides, active traffic areas, steep driveways, restricted-access properties, unsafe parking areas, or hazardous environments.
- Wrench may decline or reschedule service if the vehicle condition, location, required parts, or service request falls outside Wrench procedures or technician capability.
- Discounts may not be combined with other coupons, promotions, negotiated pricing, or offers unless expressly authorized by Wrench or MMN in writing.
- MMN does not guarantee appointment availability, technician arrival times, service outcomes, parts availability, or completion timing.
Violation of these terms may result in immediate termination of Membership without refund.
9. Service Area Availability
Membership purchase does not guarantee that all benefits are available in every ZIP code, city, county, state, or location. Wrench service coverage may vary and may change over time. Service may be unavailable or limited based on technician coverage, parts availability, weather, local regulations, property restrictions, safety concerns, or Wrench operating requirements.
If Wrench determines that service cannot reasonably be provided in a Member's area, the Member may be eligible for cancellation and refund consideration according to Section 14, depending on the plan type, purchase channel, timing, benefit usage, and applicable law.
10. Membership Fees, Billing, and Billing Descriptor
Membership pricing, payment timing, billing frequency, taxes, fees, and plan features will be disclosed at checkout or in plan-specific materials. By purchasing a Membership, you authorize MMN, SPS, Wrench where applicable, and their payment processors to charge the payment method provided for all applicable Membership fees, recurring subscription charges, taxes, and authorized fees.
Charges may appear on your credit card, debit card, bank statement, digital wallet, or payment account as Secure Private Sale Solutions, SPS, MobileMechanicNow, MMN, or a similar billing descriptor. This disclosure is intended to help Members recognize their purchase and reduce mistaken disputes or chargebacks.
11. Subscription Plan Automatic Renewal Terms
Subscription Plans, including FlexCare, are recurring membership subscriptions. Unless cancelled in accordance with these Terms, a Subscription Plan will continue and recurring charges will be billed to the payment method on file at the disclosed billing frequency.
By enrolling in a Subscription Plan, you acknowledge and agree that:
- The subscription continues until cancelled.
- You authorize recurring charges to your payment method until cancellation is effective.
- The amount charged, billing frequency, and cancellation procedure will be disclosed at checkout and/or in your order confirmation.
- You are responsible for keeping your payment method and contact information current.
- If payment fails, is declined, is returned, is reversed, is disputed, or cannot be processed, your Membership benefits may be suspended or terminated.
- Cancellation stops future recurring charges but does not create a refund right except as expressly stated in Section 14.
12. Future Subscription Price Changes
MMN reserves the right to increase or otherwise change pricing for existing Subscription Plan Members with advance notice, subject to applicable law. Notice may be provided by email, SMS, account notice, website notice, order portal notice, or other lawful method using the contact information associated with the Membership.
Unless a longer notice period is required by applicable law, MMN will use commercially reasonable efforts to provide at least thirty (30) days' advance notice of material subscription price increases affecting existing Subscription Plan Members. Continued participation in the Subscription Plan after the effective date of the price change constitutes acceptance of the revised pricing. If you do not agree to the revised pricing, you must cancel your Subscription Plan before the effective date of the change to avoid future charges at the revised price.
13. California Automatic Renewal and Checkout Disclosure
For Subscription Plans sold to California consumers or where California law applies, MMN intends to provide clear and conspicuous automatic renewal terms before purchase, obtain affirmative consent to recurring billing, provide a post-purchase acknowledgment containing the subscription terms and cancellation information, and make cancellation available through legally required methods.
Before completing a Subscription Plan purchase, Members may be required to check a box or otherwise affirmatively acknowledge substantially similar language:
"I understand that FlexCare is a recurring membership subscription. My payment method will be charged on a recurring basis until I cancel. I understand the 60-day waiting period, cancellation policy, refund policy, and that charges may appear as Secure Private Sale Solutions, SPS, MobileMechanicNow, or a similar billing descriptor."
This section is intended to support compliance planning and should be reviewed by legal counsel before publication and implementation.
14. Cancellation and Refund Policy
Cancellation requests may be submitted to MobileMechanicNow using the contact information below. MMN only processes cancellations and refunds for Memberships purchased directly through MobileMechanicNow. Memberships purchased through Wrench directly, third-party sellers, affiliates, marketplaces, employers, benefit providers, or other distribution channels must be cancelled through the original selling party or as directed by that party.

A. Subscription Plans, Including FlexCare
- Within sixty (60) days of purchase: A full refund will be issued if no Membership benefits or services have been used, redeemed, scheduled, received, or attempted to be redeemed.
- After sixty (60) days: No refund will be issued.
- Cancellation after sixty (60) days stops future recurring charges after the cancellation is processed, but previously paid subscription fees are not refundable unless required by law.
- Membership benefits terminate upon cancellation or at the end of the then-current billing period, depending on MMN's then-current cancellation processing rules and applicable law.
B. Prepaid 2-Year and 3-Year Plans
- Within sixty (60) days of purchase: A full refund will be issued if no Membership benefits or services have been used, redeemed, scheduled, received, or attempted to be redeemed.
- After sixty (60) days, or after any benefit has been used, redeemed, scheduled, received, or attempted to be redeemed: Refunds will be calculated on a prorated basis based on the remaining unused Membership term and remaining unused benefits, less a mandatory fifty-dollar ($50) cancellation fee.
- The prorated refund calculation may deduct the retail value, reasonable value, or program value of benefits already used, redeemed, scheduled, received, or attempted to be redeemed. The refund will be calculated using the method most protective of MMN and Wrench to the fullest extent permitted by law, subject to legal compliance and attorney review.
- No refund will include the value of completed, used, redeemed, scheduled, or received benefits.
- Membership benefits terminate upon cancellation.
Refunds, if approved, will generally be issued to the original payment method, contract holder, or other party legally entitled to receive the refund. Processing times may vary by payment processor, bank, and administrative requirements.
15. Vehicle Transfers
Membership benefits may be transferable to another eligible vehicle owned or controlled by the Member only as described below. A transfer is not guaranteed and remains subject to eligibility review, service availability, plan status, accurate vehicle information, and approval requirements.
- Prepaid Plans: Benefits may be transferred to another eligible vehicle by contacting Wrench directly and obtaining Wrench approval.
- Subscription Plans: Benefits may be transferred to another eligible vehicle by contacting MobileMechanicNow and obtaining approval from both MobileMechanicNow and Wrench.
- No fixed transfer limit is stated in these Terms; however, MMN and Wrench may deny, delay, or condition any transfer that appears abusive, fraudulent, impractical, inconsistent with plan intent, or otherwise inconsistent with applicable eligibility rules.
- Benefits may not be sold, assigned, leased, shared, brokered, or transferred to another person, household, or commercial entity except as expressly approved in writing.
16. Third-Party Service Disclaimer
MMN and SPS are authorized resellers and membership distributors only. MMN and SPS do not perform maintenance services, employ technicians, supervise Wrench technicians, control Wrench scheduling, guarantee Wrench service availability, or warrant the work performed by Wrench or its providers.
All scheduling, service performance, technician dispatch, parts usage, service quality, appointment timing, technician conduct, service warranties, and service-related issues are the responsibility of Wrench and/or its authorized service providers, subject to Wrench policies and applicable law. MMN may assist with billing, cancellation, refund status, and general customer support for Memberships purchased directly through MobileMechanicNow.
17. Warranties and Service Issues; Insurance
Any service warranty, workmanship warranty, parts warranty, remedy, re-service procedure, or service-related claim is governed by Wrench policies and applicable law. Members should contact Wrench directly for scheduling, maintenance issues, service performance concerns, technician-related matters, appointment issues, or warranty matters.
MMN does not make independent warranties regarding services performed by Wrench or its service providers. To the fullest extent permitted by law, MMN disclaims implied warranties arising from or related to services performed by Wrench or third parties. Member acknowledges and understands that Wrench may use affiliates and subcontractor to provide services, and MMN does not control Wrench’s choice of specific technicians. MMN does not provide insurance coverage for services performed by Wrench. Member assumes all responsibility for confirming that Wrench maintains licensure required by law and appropriate insurance (general liability, auto, professional/garage, workers’ comp) at acceptable limits. Each Member is responsible for his/her own insurance (vehicle, property, health) and is advised to confirm that such policies cover any mobile service events on their premises.
18. Use Restrictions
You agree not to:
- Circumvent Wrench scheduling, pricing, service, parts, eligibility, or operational policies.
- Make separate payment arrangements, side agreements, cash payments, or unauthorized arrangements with Wrench technicians or service providers.
- Misrepresent your identity, contact information, payment information, vehicle information, VIN, mileage, location, ownership status, service history, eligibility, or Membership status.
- Use Membership benefits for commercial, fleet, rental, rideshare, delivery, resale, or business purposes unless expressly authorized in writing.
- Use benefits for a vehicle other than the registered eligible vehicle unless an approved transfer has been completed.
- Resell, assign, broker, advertise, sublicense, share, or transfer Membership benefits except as expressly allowed by these Terms.
- Submit fraudulent, abusive, duplicative, misleading, or bad-faith service requests, cancellation requests, refund requests, chargebacks, or claims.
- Interfere with Wrench technicians, service providers, systems, scheduling tools, or customer service processes.
- Use abusive, threatening, harassing, discriminatory, unsafe, or unlawful conduct toward MMN, SPS, Wrench, technicians, service providers, or support personnel.
- Attempt to obtain benefits after cancellation, suspension, expiration, payment failure, or termination.
- Reverse engineer, exploit, manipulate, or misuse any membership system, discount, coupon, billing process, or scheduling process.
- Violate any applicable law, regulation, or third-party policy in connection with the Membership.
19. Suspension and Termination
In the event of a Member’s fraud, abuse, non-payment, safety or legal risks, or violation of law or Use Restrictions, as determined by MMN in its sole discretion, MMN may immediately suspend or terminate the Member’s Membership and related benefits without refund, deny future service, cancel scheduled service, refer the Member for collection, and dispute any claimed chargebacks. Where feasible, MMN will provide notice and an opportunity to cure before termination, except where immediate action is reasonably necessary to protect safety, prevent fraud, or comply with law.
20. Payment Disputes and Chargebacks
If you do not recognize a charge, you agree to contact MMN before initiating a payment dispute or chargeback so that MMN can help identify the transaction. Improper, fraudulent, or mistaken chargebacks may result in Membership suspension, cancellation, loss of benefits, denial of future service, and recovery of amounts owed to the fullest extent permitted by law.
The billing descriptor disclosure in Section 10 is provided to help Members identify charges associated with MobileMechanicNow purchases.
21. Communications Consent
By purchasing or using a Membership, you consent to receive communications from MMN, SPS, Wrench, and their service providers by email, phone, SMS/text message, account notice, mail, or other available channels. Communications may include billing notices, renewal notices, price change notices, cancellation confirmations, service reminders, appointment confirmations, account updates, support messages, customer satisfaction requests, and promotional offers.
Message and data rates may apply. You may opt out of promotional messages as permitted by law, but transactional or service-related communications may still be sent as necessary to administer your Membership.
22. Privacy
Member information may be collected, used, and shared as reasonably necessary to process purchases, administer memberships, schedule services, verify eligibility, process payments, provide customer support, communicate with Members, prevent fraud, comply with law, and coordinate with Wrench and service providers. Please review the MobileMechanicNow Privacy Policy for additional information. MMN will implement reasonable technical and organizational measures to protect personal information, consistent with the SPS Privacy Policy then in effect.
23. Limitation of Liability
To the fullest extent permitted by law, MMN, SPS, their affiliates, owners, officers, directors, managers, employees, contractors, agents, vendors, successors, and assigns shall not be liable for indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, including loss of use, lost profits, lost revenue, loss of transportation, substitute transportation costs, diminished value, inconvenience, emotional distress, or other consequential losses arising out of or relating to a Membership, Wrench services, technician performance, service delays, scheduling issues, payment issues, cancellation, or these Terms.
To the fullest extent permitted by law, MMN and SPS shall not be liable for personal injury, property damage, vehicle damage, service dissatisfaction, missed appointments, service quality, warranty disputes, parts issues, technician conduct, or any act or omission of Wrench or its authorized providers.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, limitations apply to the maximum extent permitted by law.
24. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless MMN, SPS, Wrench, their affiliates, owners, officers, directors, managers, employees, contractors, agents, service providers, vendors, successors, and assigns from and against any claims, demands, damages, losses, liabilities, costs, expenses, and attorneys' fees arising out of or relating to:
- Your use or attempted use of Membership benefits.
- Your vehicle condition, location, ownership status, or service history.
- Your breach of these Terms.
- Your violation of law or third-party rights.
- Your misuse, fraud, misrepresentation, abuse, or unauthorized transfer of benefits.
- Any claim arising from inaccurate information you provide.
25. Dispute Resolution, Arbitration, Small Claims, and Class Action Waiver
Except for claims that may properly be brought in small claims court, any dispute, claim, or controversy arising out of or relating to this Agreement, a Membership, any purchase through MMN, any billing or refund issue, or any relationship with MMN or SPS shall be resolved by binding individual arbitration administered by the American Arbitration Association or another mutually agreed arbitration provider.
The arbitration shall take place in Santa Clara County, California, unless the parties agree otherwise or applicable law requires a different forum. The arbitrator shall have authority to award individual relief available under applicable law but shall not have authority to conduct class, collective, consolidated, representative, or private attorney general proceedings unless required by law.
Small Claims Carve-Out: Either party may bring an individual claim in small claims court if the claim qualifies and remains in small claims court. This carve-out is intended to preserve a practical, lower-cost forum for qualifying individual disputes while maintaining arbitration for other disputes.
Class Action and Jury Trial Waiver: To the fullest extent permitted by law, you and MMN/SPS waive the right to a jury trial and waive the right to bring, join, or participate in any class action, collective action, consolidated action, representative action, or private attorney general action.
This Section survives cancellation, expiration, termination, chargeback, payment dispute, or any other end of the Membership relationship.
26. Governing Law
This Agreement shall be governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent federal law applies or preempts state law. Nothing in this Agreement is intended to waive non-waivable statutory rights, and where local law grants additional cancellation or refund rights, those laws will prevail.
27. Age Requirement
You must be at least eighteen (18) years old and legally capable of entering into a binding agreement to purchase or use a Membership.
28. Changes to Benefits, Partners, and Terms
MMN and Wrench reserve the right to modify, replace, suspend, discontinue, or update Membership benefits, participating partners, service providers, coverage areas, eligibility criteria, benefit limits, discount amounts, operational procedures, plan names, plan structures, pricing, and these Terms from time to time, subject to applicable law. If applicable laws or regulations change in a way that materially affects the feasibility, cost, or legality of offering the Membership, MMN may adjust benefits, pricing, terms, or discontinue the Membership in a manner that complies with applicable consumer notice and automatic renewal rules.
For Subscription Plans, material price increases affecting existing subscribers will be handled as described in Section 12. For Prepaid Plans, MMN will not reduce the stated term already purchased, but benefit administration remains subject to Wrench availability, partner participation, service area limits, eligibility, and lawful program updates.
Updated Terms may be posted on MobileMechanicNow.com, sent by email, included in account notices, or otherwise provided as permitted by law. Continued use of a Membership after updated Terms become effective constitutes acceptance of the updated Terms to the fullest extent permitted by law.
29. No Waiver; Severability
Failure by MMN or SPS to enforce any provision of these Terms does not waive the right to enforce that provision later. If any provision is found unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law, and the unenforceable provision will be modified or severed as necessary to preserve the intent of the Agreement.
30. Entire Agreement
These Terms, together with any plan-specific checkout disclosures, order confirmation, Privacy Policy, and applicable Wrench policies, constitute the agreement between you and MMN/SPS regarding the Membership. No oral statement or informal communication modifies these Terms unless confirmed in writing by an authorized representative of MMN or SPS.
